FDA Sends Warning Letters to Companies Marketing Illegal Flavored Cigarettes

The U.S. Food and Drug Administration (FDA) has issued warning letters to companies that use their web sites to sell illegal flavored cigarettes to stop marketing and selling these products immediately or take other actions to bring the products into compliance with the law. Enforcement of the Tobacco Control Act and its ban on flavored cigarettes represents an effort by FDA to remove cigarettes that contain candy or fruit flavors from the marketplace as a way to prevent children and adolescents from starting smoking.  In a November 6, 2009 press release, Lawrence R. Deyton, M.S.P.H, M.D., director of FDA’s Center for Tobacco Products said, “FDA takes the enforcement of this flavored cigarette ban seriously. These actions should send a clear message to those who continue to break the law that FDA will take necessary actions to protect our children from initiating tobacco use.” The warning letters issued by FDA can be found at http://www.fda.gov/ICECI/EnforcementActions/WarningLetters/2009/default.htm.
